These Website Terms and Conditions apply to kayak-analytics.com (the Website), operated by KAYAK ANALYTICS PTE LTD, a company incorporated in Singapore (UEN 201611647N), of 59 Jalan Pemimpin, #05-01 L & Y Building, Singapore 577218 (Kayak, we, us or our).
Please read these terms before using the Website. By using it, you agree to these terms to the extent that they are validly incorporated and enforceable under applicable law. If you do not agree, please stop using the Website. If you act for an organisation, you must have authority for any commitment you make on its behalf.
The Website provides information about Kayak and its energy and industrial analytics capabilities. It is intended primarily for business enquiries. These terms govern the public Website; they are not a subscription, software licence, service-level agreement or commitment to deliver a project.
Submitting an enquiry, requesting a demonstration or receiving an automated acknowledgement does not by itself create a contract for products or services. Website descriptions are invitations to discuss your requirements, unless we expressly state otherwise.
Access to software, demonstrations, trials, proofs of concept, data processing and commercial services may be subject to separate terms agreed with the relevant Kayak contracting entity. A signed customer agreement, proof-of-concept agreement, software agreement or non-disclosure agreement takes precedence over these Website terms for its subject matter. These Website terms do not amend those agreements or extend their rights to other visitors.
Website materials, illustrations, screenshots, demonstrations and case studies explain capabilities and possible applications. They are general information, not instructions for operating equipment, an engineering assessment of your assets or a guarantee of performance, savings, availability, fault detection or regulatory compliance. Results depend on the asset, data quality, configuration, operating conditions and scope agreed with the customer.
AI and analytical outputs can contain errors, omissions or uncertainty. Forecasts, anomaly indicators, recommendations and remaining-life estimates require contextual assessment by appropriately qualified personnel. They must not be the sole basis for safety-critical, maintenance, dispatch, protection, switching or other operational decisions.
The public Website does not provide operational control of energy or industrial assets. Visiting it or requesting a demonstration does not authorise control actions or replace your operating procedures, engineering checks, manufacturer requirements or safety obligations.
The Website and its text, graphics, software, designs and other content belong to Kayak or its licensors, except where identified otherwise. Names, trademarks and logos of customers, partners and other third parties remain the property of their respective owners.
You may view the Website and download or print reasonable extracts for lawful personal use or internal business evaluation of Kayak, keeping ownership notices intact. Mandatory statutory rights remain unaffected. Liability for contracted products and services is governed by the applicable customer agreement, not this Website clause.
We may revise these terms and will display the updated version and date on this page. Changes apply prospectively and do not amend a separate agreement or remove accrued rights. Where applicable law requires notice or agreement, we will comply with that requirement. Please review this page when returning to the Website.
If a provision is unenforceable, the remaining provisions continue to apply so far as permitted by law. A failure or delay in exercising a right does not by itself waive that right.
These Website terms are governed by Singapore law. Subject to any mandatory rights or rules of jurisdiction that apply, disputes relating to these terms or the public Website are subject to the exclusive jurisdiction of the Singapore courts. This does not change the governing law or dispute process in a separate agreement.
